These terms are an agreement between you and Zero to Diamond, LLC ("we", "us"), the operator of ZTD Data. By creating an account or buying credits you agree to them. If you don't agree, don't use the service.
1. What the service is
ZTD Data lets you build and download lists of property owner records (names, phone numbers, email addresses, property and mailing addresses, and related property attributes) for areas you choose. We source records from third-party data providers and public records. We sell access to data. We do not sell results.
2. Credits and pricing
Credits are prepaid. One credit buys one delivered record. The current price is $0.05 per credit with a minimum purchase of 400 credits. Optional add-ons such as TCPA litigator removal and Do Not Call removal cost extra credits per record, shown before you buy. Credits do not expire. Credits are not refundable for cash except where the law requires it. If a list delivers fewer records than you paid for, the difference is returned to your credit balance automatically.
Card payments are processed by Stripe and collected by Peak Leads LLC on behalf of Zero to Diamond, LLC. Charges may appear on your card statement under the name Peak Leads LLC.
3. You are responsible for how you use the data
This is the important part. When you contact anyone on a list you buy from us, you are the one making the call, sending the text, or mailing the letter. You alone are responsible for complying with every law that applies to that contact, including the Telephone Consumer Protection Act (TCPA), the National Do Not Call Registry and state do-not-call lists, the CAN-SPAM Act, the Fair Housing Act, state real estate licensing rules, and any rules of your brokerage or MLS. Records may include numbers on the Do Not Call registry, numbers belonging to known TCPA litigators, and people who have not agreed to be contacted. Our optional scrubs reduce that risk but do not eliminate it, and we make no promise that any record is lawful for you to contact by any particular method.
You agree not to use the data to send unsolicited automated or prerecorded calls or texts without the consent the law requires, not to use it for any purpose prohibited by the Fair Credit Reporting Act (including decisions about credit, insurance, employment, or housing eligibility), and not to use it to harass, stalk, or discriminate against anyone.
If we send records into a third-party system you connect (such as a CRM), we only add contacts and tags. We never trigger messages or automations. Anything that happens after that is configured and owned by you.
4. Accuracy
Data changes constantly. People move, sell, change numbers, and pass away. We deliver the best records our providers have at the moment you order, and we make no warranty that any record is current, accurate, or complete. Match rates vary by area. Counts shown before purchase are estimates from the provider and can differ from what is delivered.
5. What you may not do
You may not resell, sublicense, or redistribute records to third parties as a data product. You may not scrape, mirror, or reverse engineer the service. You may not share your account. You may not use the service if you are under 18. We may suspend or close accounts that violate these terms, and credits in a closed account are forfeited when the closure is for a violation.
6. Your account
Keep your password safe. You are responsible for activity under your account. Tell us at support@zerotodiamond.com if you think someone else has access.
7. Limits on our liability
The service is provided as is. To the fullest extent the law allows, we are not liable for any indirect, incidental, or consequential damages, or for any fines, penalties, judgments, or settlements you incur from contacting people on lists you buy. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim. You agree to defend and indemnify us against claims arising from your use of the data.
8. Changes and termination
We can change these terms and the price of credits. We will post changes here and the date at the top will update. Credits you already own keep their value. You can close your account any time by emailing us.
9. Governing law
These terms are governed by the laws of the State of Alabama. Any dispute will be resolved in the state or federal courts located in Alabama.
